Mastering the rules governing patent litigation is essential. Practitioners handling patent cases must become acquainted with the local rules regardless of where a case is filed. Finding the rules themselves is typically easy and accessible online. But it is more difficult and time consuming to find cases actually construing the rules and judges actually applying them to facts and circumstances. Abiding by and knowing the rules and their application is critical and can be outcome determinative. The purpose of this publication is to set forth the cases that so far have construed the Northern District of Georgia local patent rules. This should help practitioners handling such cases.
